Fatal Domestic Shooting on Emerald Place

There was a shooting last night on Emerald Place. According to a reader report there was a shooting between 13th and 14th on Emerald. The cops suggest it was a domestic incident ("between two families") and the victim who was taken off in an ambulance. 13th Between E and F was closed as was Emerald between 13th and 14th. The victim was a 52 year old male, and he died from his wound.

Earlier this year, the father of the victim was featured in a Washington Post story on the changing demographics of ex Mayor Barry's neighborhood. Mr. Bigalow was sitting beside his son on a bench in the front when his son was shot. This is such a senseless tragedy.

There was another murder (stabbing) a few blocks away on 16th. All in one weekend. The Post is covering them both, but has no info on motives, etc. The locations seem coincidental, even if the crimes were very intentional.

Why the 2nd degree muder change in the Bigalow case? Does this really mean that you you can show up at someone's house and kill "the wrong person" that the murder charge is reduced? Or is this a case of a lazy justice system that doesn't care because the victim and his family are just working class afro-americans?

I think the difference in murder charges involves intent/premeditation and/or in the commission of another crime especially a felony like burglary. If the killing wasn't while committing another felony and there is no way to prove premeditation they go for second which is more intent to harm but not necessarily kill (but killing was the result).

But don't quote me - I'm not a cop or lawyer.

Seems as though premeditation is the distinguishing characteristic. Aren't they all premeditated though? Some could premeditate for a couple days, others a few seconds. Where is the line drawn?

Would non premeditated be like if somebody bumped your car and you get out and shoot them?

Carrying a gun to someone's house that had a stay away order seems pretty premeditated to me.
