A reader sends word that her block is holding a yard sale:
[W]e are trying to get word out about our block yard sale which is taking place this Saturday, June 13th on the 800 block of 5th Street NE from 8:30AM-12:30PM. A number of families on both sides of the street will be participating and they'll be an array of items from toys to books available for purchase.

That's the block with the non-smoking neighbor who is new to the neighborhood who got an injunction to prevent the smoking long time neighbor from smoking in his house. I bet it's gonna be a little tense!

Based on the description, 831 5th street is the perp. Either 829 or 832 are the vic.

So, from that story, the problem isn't the smoking, so much, but disrepair that allows the smoke to infiltrate the neighboring home. The story seems to indicate that the "new" owners would be willing to chip in for the repairs that would fix the problem, but the "old" owners have balked at doing anything. Given those facts, I'm not terribly sympathetic to the "old" owners. I smoke in my home. When a neighbor complained that she could smell it, with specific times when I'm enjoying a cig in my home (I do work, and I'm not a chimney) and a locale where she was smelling it, we found an old common plumbing line that wasn't sealed properly, and I had it sealed up, and all was well. I do feel "entitled" to smoke in my own home, but not without making sure it doesn't bother the neighbors, reasonably. "Reasonably" is that there are no direct openings into my neighbors' homes that I can fix..."unreasonably" would be "close your windows because I have a right to have mine open."

This issue is actually about new people moving into a neighborhood and telling the people that were living there previously how to live.

5:18, apparently that's not my job, that is the job of the neighbors next to 830 5th St, NE, who are legally enforcing the way they think.
Simple solution: when the baby is born sue them for the baby crying and keeping you up at night with noise violations. They could choose not to have the child. Noise violations and lack of sleep are health concerns.
