1115 H Street NE back in 2016
Twitter user @TheX2BusDC, who also runs a local blog, posted photos of construction at 1111 H Street NE. As you can see in the photos below, the new building is going up right next the the condo building at 1115 H Street NE (originally known as the Woolworth Condominiums, the building's name was later changed to 1115h. The website is no longer active, but you can still view an archived version from August 2012 thanks to the Internet Archive's Wayback Machine.
This is what happens when you build side balconies that look out over a neighboring property that you don't own and where the current or future owner could still build up just like you did.how in the world did the builders of 1115 h not have the air rights to block the new building. everyone's balconies are straight up nullified. pic.twitter.com/wg7wuXUKZj— The X2 (@TheX2BusDC) July 23, 2018

WOW. They even advertise the "juliette balconies" on their site. I'm willing to bet that the whole air rights issue was in the paperwork, but either obfuscated by language or ignored by buyers as 'the fine text' of what amounts to a ton of paperwork at closing that nobody reads thoroughly. Maybe some folks probably were aware, but thought that nobody in their right mind would build right up to a balcony. Jeez, what a pickle for the owners. I wonder what one could do to turn the balcony into an opportunity? I mean, forget the inevitable lawsuits. As an owner, how could one best utilize the space? Maybe a darkroom for photographers??? /s
The owners of these units tried to get the ANC to help when plans started in 2016, but the developers of the adjacent construction fought hard with fancy lawyers and promises to clean up the block. :(
I heard this new building is going to be a walk-up? Is that okay by ADA?
I never comment but I'm MAD for the owners of this building! Not a nice way to come to the neighborhood.
Wow...
Someone forgot to check their air rights.
Frankly this was a poor approval by DCRA Zoning/Planning.
It's like approving windows ona zero-clearance lot line.
A whole bunch of condo's just had their value seriously impaired.
